Terms and Conditions of Sale & Website Use

Please read carefully. By placing an order with us, you agree the following Terms and Conditions (‘the Terms’):

1. Definitions

1.1. ‘We/us/ours’ means iGADGET London Limited, a company registered in England and Wales, company registration number 10345011, and whose registered office address is 33, Armstrong House, 58A High Street, Uxbridge, Middlesex, UB8 1GJ, United Kingdom.

 

1.2. ‘You/your/yours’ means the person, firm, company, or organisation buying the Goods subject to these Terms and Conditions.

 

1.3. ‘The Goods’ means the goods which are to be sold under a contract of sale (‘the Contract’), between the parties.

 

1.4. ‘The Supplier(s)’ means any person, firm, company, or organisation contracted by the Seller to supply or assist in the manufacture, supply or delivery of the Goods.

2. Website Usage

You must be eighteen years old to use this iGadget London website www.igadgetlondon.com (‘the Website’). If you are under eighteen, you may only use the site or place an order in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site or place an order.

3. Website Content

We may change the content of the Website and the Terms (which would replace these Terms) at any time without notifying you. Any changes to these Terms will be posted on this Website and by continuing to use this Website following any such change, you agree to be bound by the revised Terms.

4. Website Availability And Warranty Disclaimer

To the full extent permissible under applicable law, we disclaim the following warranties and any and all such warranties:

 

(a) the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;

 

(b) that the Website or the service will meet your requirements, will always be available, accessible, uninterrupted, timely, secure or operate without error;

 

(c) the information, content, materials or products included on the Website will be as represented by sellers, available for sale at the time of listing, lawful to sell, or that sellers or buyers will perform as promised.

 

(d) any implied warranty arising from course of dealing or usage of trade; and

 

(e) any obligation, liability, right, claim or remedy in tort, whether or not arising from our negligence.

5. Registration - Username And Password

5.1. You shall choose a username and password on completion of registration.

 

5.2. You are responsible for all actions taken under your username and password and shall use the Website only under your own username and password.

 

5.3. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, or you have reason to believe it is or may be compromised, you shall notify us in writing (which may include email) to advise us of the same, and you shall change your password immediately.

 

5.4. You shall not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.

6. Formation Of Contract

6.1. The Contract shall be formed by our acceptance of an order placed by you for the Goods.

 

6.2. You will be deemed to have placed an order when we receive notification of your payment.

 

6.3. We will be deemed to have accepted your order by sending an email confirmation (‘the Confirmation’) of your order directly to you.

 

6.4. Our acceptance of any order placed by you shall be subject to these Terms and Conditions which shall override any other document or any other communication (written or oral) between the parties, unless agreed in writing by us.

 

6.5. We may at our discretion add, vary or withdraw products listed on the Website, or on any other literature, electronic or otherwise, published by us, at any time without notice.

7. Basis Of Sale

7.1. All Goods are supplied subject to availability.

 

7.2. Although all reasonable efforts have been made to ensure that the details, descriptive information, and specifications of the Goods are as accurate and up to date as possible, such details do not constitute a trade description.

 

7.3. Any errors or omissions on the Website, or on any other literature, electronic or otherwise, published by us shall be subject to correction, without any liability accruing to us.

 

7.4. You shall be solely responsible for the accuracy of all orders.

8. Prices, Taxes

8.1. The price of the Goods shall be as shown on the Website. We may increase the price prior to delivery and inform you if the increase is due to circumstances beyond our control.

 

8.2. We may vary the price(s) of any Goods on the Website at any time and without notice.

 

8.3. Delivery charges and VAT for the Goods are as stated on the Website and will be confirmed in the Confirmation.

 

8.4. Non-UK customers shall be responsible for their own local taxes and custom duty charges, and we accept no liability in respect of the same.

9. No Obligation To Fulfil

9.1. In the event that an error is discovered in the price of the Goods that you have ordered, we will inform you as soon as possible.

 

9.2. We shall be under no obligation to fulfil an order for Goods which were advertised at an incorrect price. If the Goods have been charged and not dispatched we will cancel and refund your order.

10. Payment Terms

10.1. You shall make full payment of the price of Goods ordered at the time of placing the order.

 

10.2. Payment shall be by PayPal where possible or by other agreed method defined in the payments section.

11. Gift Vouchers

11.1. These Terms apply to gift vouchers which have been purchased from us.

 

11.2. Gift vouchers can be redeemed at iGADGET London website www.igadgetlondon.com on any purchase made in GBP Sterling or purchase currency only.

 

11.3. If the value of the Goods ordered exceeds the value of the voucher you shall be liable to pay the balance by either credit/debit card.

 

11.4. If the full amount of the voucher is not redeemed, ‘change’ will be given by way of a new voucher. Change vouchers are also subject to these Terms and are additionally not assignable or transferable.

 

11.5. Gift vouchers cannot be used to buy further gift vouchers.

 

11.6. Gift vouchers cannot be used in conjunction with a discount voucher.

 

11.7. Gift vouchers and unused portions expire one year from the date of issue of the original gift voucher.

 

11.8. Gift vouchers have a cash redemption value of 0.001p and are not transferable or assignable.

 

11.9. Please note that some products available for sale on the Website may not be purchased by persons under a specified age. If you are planning to give a gift certificate to someone under 18 years of age, please ensure that they are made aware that some products are unavailable to them.

 

11.10. One or more gift certificates can be redeemed against an order; however a gift certificate cannot be combined with a promotional gift certificate.

12. Customer Loyalty Program

All Goods purchased by you will earn you some points based on the purchase price. The accumulated points can be redeemed by you against your next purchase.

13. Address For Delivery

13.1. Your first order shall be sent to your billing address.

 

13.2. For subsequent orders, you may nominate an alternative address for delivery, which shall be at your own risk.

14. Despatch

14.1. We aim to despatch Goods the same day of receipt of your order or the next working day for next day delivery within the UK. All international orders will be processed and despatched within 2 working days of receipt of your order.

 

14.2. In the event that the Goods ordered by you are not available at the time the order is placed, we will notify you by email of the estimated time for delivery of the Goods ordered as soon as possible.

 

14.3. Orders may be delivered in instalments in the event that you order more than one item.

15. Inspection Of Goods And Action Upon Delivery

15.1. You shall inspect the Goods immediately on delivery and no claim for shortages or errors in delivery or damage in transit which would be evident on inspection will be considered by us unless you notify us by telephone or email quoting the delivery note or invoice number within 24 hours of the time of delivery.

 

15.2. We shall not consider any claims for non-delivery of Goods unless you notify such claims to us by telephone or email within 14 days of the date of the Confirmation.

 

15.3. In the absence of any such notification in accordance with this Clause 15 we shall be deemed to have delivered the Goods in full to you.

 

15.4. In the event that the Goods are defective on arrival, you may return them to us and obtain a refund. You shall be responsible for all shipping costs. If the product returned is not in a fully re-saleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item. We shall refund the shipping cost only where the Goods are faulty, damaged or not as described.

 

15.5. We reserve the right to make a 15% restocking charge for Goods which are not returned in mint condition or to refuse to accept such Goods, at our sole discretion.

16. Limitation Of Liability

Except for death or personal injury caused by us, we shall not be liable for any representation, implied warranty, condition or other terms or duty in common or at common law, for any consequential loss or damage, costs or expenses of whatever nature which arise from the supply of Goods or their use or resale unless expressly provided in these Terms.

17. Credit Card Checks

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases including registered Credit Reference agencies and fraud prevention agencies, who may keep a record of that information. By accepting these Terms you consent to such checks being made.

18. Your Privacy And Our Use Of SSL Technology

18.1. We comply with the Data Protection Act 1998 and GDPR.

 

18.2. As required by the Data Protection Act 1998, all information supplied by you to us will be treated in a manner compliant with our obligations under the Act. It is your responsibility to ensure that all the information you provide to us is accurate.

 

18.3. iGADGET London Ltd tracks the electronic ‘fingerprints’ of every order placed via the Website using SSL technology to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on the Website. It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

19. Risk

19.1. Risk shall pass to you where Goods are stored by us upon such Goods being stored, and in all other cases upon delivery or attempted delivery (in the event that you refuse delivery or your address cannot be found or accessed).

 

19.2. Risk in any Goods to be returned remains with you until the Goods are delivered to or collected by us.

20. Cancellation Of Order And Refunds

20.1. In the event that you wish to cancel your order, press ‘cancel’ or delete the order if it is during checkout. If you have already placed your order, you must contact us via email or telephone or the ‘Contact us’ page and request the order to be cancelled.

 

20.2. You are entitled to cancel your order within 14 days after your receipt of the Goods.

 

20.3. You shall return the Goods to us at your expense and you are advised to insure the Goods adequately for this purpose.

 

20.4. If Goods returned by you are lost, we will not be liable to you in any way whatsoever.

 

20.5. If you do not return the Goods within 14 days of cancellation, or if you so request, we have the right to recover the Goods from you and to deduct the cost of such recovery from any refund to which you may be entitled.

 

We reserve the right to make a charge for collecting Goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

 

20.6. We will refund the amount paid by you for the Goods within 30 days from the day on which notice of cancellation is received. Refunds for valid claims will be made via the same method of payment as used by you to place the order.

 

20.7. We reserve the right to make a 15% restocking charge for Goods which are not returned in mint condition or to refuse to accept such goods, at our sole discretion.

 

20.8. We reserve the right to make a charge for collecting Goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

21. Warranty On Electronic Goods

All Goods are covered by a manufacturer’s warranty. In the event that your Goods develop a fault while under warranty, please contact us or the manufacturer directly.

 

The warranty period is as stated on the product detail page, if there is no warranty period stated on the product detail page then product will carry a standard 12 months warranty.

 

All purchased products need to be registered on our website to qualify for the warranty claims.

22. Inability To Supply

We shall not be liable to you for breach of contract by reason of delay or failure to perform any of our obligations if the delay or failure is to any extent due to a cause beyond our control including but not limited to war, fire, accident, breakdown of plant or machinery, industrial action/dispute (including strikes and lockouts), unavailability of or restrictions on supplies or disputes with Supplier(s), non-delivery or delay in the delivery of materials or other circumstances which directly or indirectly or hinder due performance of the Contract.

23. Your Reviews And Feedback

23.1. You agree to indemnify and hold us harmless against any claim or action brought by third parties, arising out of or in connection with any feedback, ratings or reviews posted by you on the website, including the violation of their privacy or intellectual property rights.

 

23.2. You grant us and our affiliate companies a non-exclusive, royalty-free worldwide license to use or edit any reviews posted by you. We reserve the right to publish, edit or remove any reviews without notifying you.

24. Your Consent For Our Marketing Purposes

By placing an order with us, you hereby agree that we may contact you for marketing purposes via email, post and phone. Should you wish to opt out, please notify us in writing (which may include by email).

25. Intellectual property rights

25.1. All content of the Website (including but not limited to content, design, text, images, audio and video material, graphics, functionality and arrangement of the Website) unless expressly stated otherwise are copyright of iGADGET London Limited / Electrolounge Limited and shall not be used or reproduced in any way without our prior written consent. All rights are reserved.

 

25.2. iGADGET London and other names of our products and/or services referenced herein are trading names, trademarks or registered trademarks and copyright belonging to Electrolounge Limited, and are protected by applicable law. Other product, trade and company names mentioned herein may be the trademarks of their respective owners.

26. Linking To Website

You may not permit, create unauthorised framing of, or deep linking to, the Website or the creation of derivative works thereof from any other website under your management or control.

27. Third Parties

The Contracts (Right of Third Parties) Act 1999 is excluded from applying to the Contract and nothing in these Terms confers or purports to confer on any third party any benefit or any right to enforce these Terms, in whole or in part.

28. Customer Queries

All queries or complaints relating to orders should be addressed to iGADGET London Limited by emailing customer.services@igadgetlondon.com. We will endeavour to respond to your correspondence within 3 working days of receipt.

29. Waiver

Failure or delay by us to enforce these Terms, or any part thereof, or any or seek remedy of any breach by you shall not be construed as a waiver of our rights to enforce the Contract and seek remedy for subsequent breach.

30. Severability

If any provision of these Terms is held invalid or unenforceable in whole or part this shall have no effect on the validity of the remaining provisions and conditions.

31. Governing Law And Jurisdiction

The Contract shall be governed by English law and shall be subject to the exclusive jurisdiction of the English courts.
